Mediation Information & Complaints Mechanism

Important to know

  1. That it is not the role of the FDR practitioner to give people legal advice.
  2. The FDR practitioner’s is subject to confidentiality and disclosure obligations (see attached s10H of The Act)
  3. The generally inadmissible status of communications made in FDR (see attached s10J of The Act).
  4. Our qualifications include law and counselling in order to be an FDR practitioner,
  5. That FDR must be attended before applying for an order in relation to a child, unless an exception applies.
  6. That if a person wants to apply to the court for an order in relation to a child they will need to obtain a certificate from the FDR practitioner before applying, unless an exception applies.
  7. That a court may take into account any certificate issued under subsection 60I(8) of the Family Law Act when deciding whether to make an order referring the people to FDR or to award costs against a person.
  8. Should you wish to complain about the FDR service we utilise the Australian Mediation Association Complaints Mechanism (see Mediation Complaints (ama.asn.au)).
